1. Eligibility

Tlntly is available only to users aged 16 years or older. By using the service, you confirm you meet this age requirement.

2. Accounts

  • You may create an account using Google or LinkedIn OAuth.

  • Account sharing is prohibited. One account = one user.

  • You are responsible for maintaining the security of your login credentials.

  • In the future, we may offer multi-user/team accounts for agencies or teams.

3. Use of the Service

  • Tlntly enables you to transform CVs into structured, editable documents, generate tailored CV variants, translate content, create motivation letters, match candidates to vacancies with AI-generated scores, and anonymize candidate details.

  • You may customize AI behavior by providing default instructions for matching and tailoring through your profile settings. These preferences are stored and applied to subsequent AI operations.

  • The platform is powered by Google Gemini API for automated processing. AI processing is essential to platform functionality and cannot be disabled.

  • By uploading data, you confirm you have the right to do so and that you are responsible for any data privacy obligations (e.g., GDPR, EU AI Act) that apply to your candidates or clients.

  • Use of Tlntly for unlawful, harmful, or abusive purposes is strictly prohibited.

  • Reselling or sublicensing Tlntly or its output is not permitted.

4. High-Risk AI System & Deployer Obligations

Tlntly's candidate-vacancy scoring and matching system is classified as a high-risk AI system under the EU Artificial Intelligence Act (Regulation (EU) 2024/1689), Annex III, Category 4. By using this system, you agree to comply with your obligations as a deployer of a high-risk AI system under Article 26 of the EU AI Act.

4.1 Your Obligations as Deployer

As a deployer of Tlntly's high-risk AI system, you agree to:

  • Use the system as intended: Use Tlntly in accordance with its intended purpose (recruitment support and candidate evaluation) and the Instructions for Use provided

  • Maintain human oversight: Assign competent, trained personnel with appropriate authority to review all AI-generated scores and recommendations before making any employment-related decision. You must not delegate final hiring, rejection, or shortlisting decisions solely to the AI system.

  • Inform candidates: Inform all candidates whose data you upload that their personal data will be processed by an AI system for recruitment purposes, and that an automated compatibility score may be generated. This notification must be provided before or at the time of data upload.

  • Facilitate candidate rights: Respond to candidate requests for explanation of AI assessments, enable candidates to contest automated assessments and express their views, and facilitate human review upon request

  • Prevent discrimination: You must not use AI-generated scores to discriminate against candidates on the basis of any protected characteristic (including but not limited to race, gender, age, disability, religion, sexual orientation, national origin, or political opinion)

  • Conduct a DPIA: Where required under GDPR Article 35, conduct a Data Protection Impact Assessment before using Tlntly to process candidate data. Information to support your DPIA is available in our Privacy Policy and Instructions for Use documentation.

  • Retain logs: Retain system-generated logs for a minimum of six months as required by Article 26(6) of the EU AI Act. Tlntly retains these logs on your behalf; you must not request deletion of these logs before the minimum retention period expires.

  • Report incidents: Promptly notify Tlntly of any suspected AI system malfunction, harmful output, discriminatory result, or security incident. Contact:

  • Monitor performance: Monitor the AI system's outputs during use and suspend use if you identify risks to health, safety, or fundamental rights

4.2 Prohibited Uses

In addition to the general prohibitions in Section 3, you specifically agree not to:

  • Use AI-generated scores as the sole basis for any hiring, rejection, promotion, termination, or other employment decision

  • Use the system to screen candidates based on protected characteristics or to implement discriminatory hiring criteria

  • Attempt to infer or detect emotional states, health conditions, or other sensitive attributes of candidates through the system

  • Use the system for social scoring or any purpose outside of recruitment and candidate evaluation

  • Upload candidate data without having a valid legal basis and without having informed the candidate

4.3 Instructions for Use

Tlntly provides Instructions for Use documentation that describes the intended purpose of the AI system, its capabilities and limitations, performance characteristics, conditions for proper use, and required human oversight measures. By using Tlntly, you acknowledge that you have received and understood these instructions. The Instructions for Use are available within the platform and upon request.

5. AI System Limitations & Disclaimer

  • AI scores are recommendations, not decisions. All AI-generated scores, rationales, tailored content, and recommendations are provided as decision-support tools. They do not constitute hiring recommendations, employment advice, or professional assessments.

  • No guarantee of accuracy: AI outputs may contain errors, inaccuracies, or biases inherent in the underlying model. You are responsible for verifying the accuracy and appropriateness of all AI-generated content before relying on it.

  • No guarantee of fairness: While we implement assessment principles designed to promote fair and evidence-based evaluation, we cannot guarantee the complete absence of bias in AI outputs. You are responsible for monitoring outputs for potential discriminatory patterns.

  • Not a substitute for professional judgment: The AI system cannot assess soft skills, cultural fit, motivation, or other qualitative factors. Human expertise remains essential for making sound recruitment decisions.

6. Plans, Billing, and Payments

  • Tlntly offers a free Starter plan and paid subscription plans (monthly or annual), billed via Stripe. The free plan includes one-time usage limits that do not reset. Paid plans include monthly-resetting usage credits.

  • Each plan includes limits on candidates, vacancies, PDF exports, and AI tokens. When you exceed candidate or vacancy limits, older records are locked while your most recently updated records remain accessible. You can unlock all records by upgrading your plan.

  • You may manage your subscription and view usage details through the in-app Settings page or the Stripe billing portal.

  • Prices are exclusive of VAT. VAT is applied to Dutch customers.

  • You will receive a Stripe invoice with each billing cycle.

  • If a payment fails, we will retry once. If payment still fails, your account will be suspended.

  • We reserve the right to adjust pricing or plan features at any time. Any changes will be communicated in advance. Continued use after such changes constitutes acceptance.

7. Cancellations & Refunds

  • You can cancel your subscription at any time via the in-app Settings page or the Stripe billing portal.

  • No refunds are offered. Billing disputes will be evaluated case by case.

  • Upon cancellation, your data remains stored so you can reactivate your subscription later. However, candidates and vacancies that exceed your plan limits will be locked, with the most recently updated records remaining accessible. AI system logs will be retained for the minimum required period (six months) regardless of cancellation. You may request permanent deletion by contacting:

8. Service Changes

We may update, modify, or discontinue features or the service at any time. We will notify users in advance when possible, and at least 30 days before material changes that affect AI system capabilities or deployer obligations. Continued use after such changes implies acceptance.

9. Termination

We may terminate or suspend your access at our discretion, without prior notice, if:

  • You violate these Terms, including the deployer obligations in Section 4

  • We detect abuse, fraud, or misuse of the platform

  • Payment is not completed after retry

  • You use the AI system in a manner that poses a risk to fundamental rights of data subjects

Upon termination, AI system logs will be retained for the minimum required retention period before deletion.

10. Intellectual Property

  • All software, branding, and design elements of Tlntly are the intellectual property of Future Visuals.

  • You may not copy, reproduce, distribute, reverse engineer, or misuse any part of the platform.

  • AI-generated outputs (scores, rationales, tailored content, motivation letters) are provided as part of the service. You may use these outputs for their intended recruitment purposes.

11. Limitation of Liability

  • Tlntly is provided "as is" without warranties.

  • We are not liable for indirect or consequential damages, including lost business, formatting issues, or AI-generated errors.

  • We are not liable for decisions made by deployers based on AI-generated scores or recommendations. The deployer retains full responsibility for all employment decisions.

  • Our maximum liability is limited to the amount you paid to us in the previous 12 months.

  • Nothing in these Terms excludes or limits liability for obligations under the EU AI Act that cannot be contractually excluded.

12. Legal Jurisdiction

These Terms are governed by the laws of the Netherlands. Any disputes shall be exclusively resolved in the courts of the Netherlands. This does not affect mandatory consumer protection rights or regulatory enforcement powers under EU law.

13. Communications & Notices

  • All official updates and changes will be communicated by email.

  • You are responsible for keeping your contact information accurate and up to date.

  • Notifications regarding AI system changes, incidents, or compliance updates will be sent to your registered email address.

14. Privacy & Data Protection

  • Use of Tlntly is subject to our Privacy Policy.

  • We act as a data processor for user-uploaded content. The processing relationship is governed by our Data Processing Agreement under GDPR Article 28.

  • As provider of a high-risk AI system under the EU AI Act, we maintain technical documentation, risk management systems, and quality management procedures as required by Articles 9 through 15.
